James Elliott Arrested for Taking Photos of Nude Children

A man has been arrested after police say he allegedly took photos of nude children through a hole in a bathroom wall that he created for viewing purposes.

49-year-old James Elliott, of State Route 12, was arrested and charged with use of a child in a sexual performance and unlawful surveillance, both felonies, according to the Lewis County Sheriff's Office.

Victims ranged in ages from four to twelve.

Elliott was arraigned in the Town of Lowville Court and sent to the Lewis County Jail on $250,000 cashing bail and $500,000 bond.

The investigation into the incidents is ongoing and further charges are pending. Federal charges are also pending after consultation from the United States Attorney's Office.

Donald Ray Eubanks Charged with Sexual Assault

A Galveston jury returned Friday guilty verdicts against a League City man on charges that he sexually assaulted two young girls, a state prosecutor and defense attorney said.

Donald Ray Eubanks, 55, remains free on bond, pending the outcome of his sentencing hearing scheduled for 9:30 a.m. Monday in Judge Wayne J. Mallia’s 405th District Court in Galveston, prosecutor Paul Darrow said.

The jury found Eubanks guilty of two counts each of aggravated sexual assault, indecency with a child, possession of child pornography and sexual performance of a child, Darrow said.

The charges stem from acts that occurred in Eubank’s home in August and September 2006, according to court documents.

In closing arguments, Darrow told the jury League City police found 105 pictures on the computer.

Defense attorney Ned Barnett told the jury that Eubanks’ wife of 36 years didn’t think anything was going on inside the house and asked the jury to consider whether there was any reasonable doubt to the charges.

Darrow told jurors they should be angry that the acts occurred in their community.

“This is a chance to send a message that this is not acceptable in Galveston County,” Darrow said. “It’s also a chance to send a message to someone else ... that’s a child molester that hasn’t been caught yet.”

Because Eubanks committed the offenses in 2006 under different state penalty statutes, he is eligible for probation on all guilty verdicts, Darrow said.

Bernard Albina Arrested for Sexually Abusing 4 Boys

Prosecutors say an orthopedic surgeon has been arrested and charged with the alleged sexual abuse of at least four young boys, some of whom were patients.

Sixty-9-year-old Bernard Albina was arrested Tuesday and charged with five counts of sexual abuse, including continuous sexual abuse of a child, sexual assault of a child and promotion of child pornography.

Harris County Assistant District Attorney Eric Devlin said police officers were working 70 to 80 hours a week going through hundreds of hours of confiscated videotape of Albina with children.

A statement from St. Joseph Medical Center said CEO Phil Robinson had suspended Albina's medical staff privileges there pending further investigation. The statement said Albina had not been active at the hospital since June 1, 2008.

The Houston Chronicle reports court records did not show an attorney of record for Albina.

Jerome Alan Spencer Arrested for Sexual Battery


Pinellas County sheriff's deputies have arrested a Safety Harbor man they say committed multiple sex crimes against two children, including sexual battery on at least one of them, during the past decade.

Jerome Alan Spencer, 55, of 3104 Avocet Place faces six felony charges: one count of capital sexual battery, three counts of lewd and lascivious molestation, one count of false imprisonment and one count of sexual performance by a minor. He is being held without bail at the Pinellas County Jail.

According to the Sheriff's Office, Spencer committed the offenses between December 2000 and July 3 of this year.

The victims are a 7-year-old girl and a 15-year-old girl, authorities said. The crimes occurred at a private home in north Pinellas County. Their names are not being released because of their ages and the nature of the crime.

In August 2006, deputies say, Spencer committed sexual battery on a 12-year-old.

That same month, Spencer brought one of the girls into an empty apartment, threatened violence and told her "if she screamed he would duct tape her mouth shut," authorities say.

That victim was forced to take off her clothes, after which Spencer made a video of a sexual nature of the girl, deputies said. According to deputies, Spencer admitted after his arrest to bringing the child to the location and making a video.

From June 27 until July 3, Spencer committed lewd and lascivious acts against one of the girls "multiple times," deputies say.

Crimes against the 7-year-old occurred recently while her mother was out of the house, authorities say.

When the mother returned and discovered what happened, she contacted police. After interviews with detectives, the 15-year-old victim also was identified.

Spencer was arrested about 5:30 p.m. Thursday at 39650 U.S. Highway 19 in Tarpon Springs, where he is a maintenance worker for a condo association.

Donald Mosley Sentenced to 40 Years for Sexual Assault

A Hunt County man will spend at least the next four decades in prison, after having been found guilty of charges of sexually assaulting a child and videotaping the encounter.

Donald Brian Mosley, 43, faced up to life in prison. He had pleaded guilty in April to one count of aggravated sexual assault of a child and one count of sexual performance by a child. He entered open pleas of guilty to both charges, meaning no potential sentence in the case had been offered or arranged.

Following a hearing in the 354th District Court, Judge Richard A. Beacom sentenced Mosley Thursday to 40 years in the Texas Department of Criminal Justice-Institutional Division on each count, according to Hunt County District Attorney Noble D. Walker Jr.

“We are extremely pleased with the sentences handed down by Judge Beacom,” Walker said. “Since the judge ordered that the sentences were to run consecutively, or “stacked”, the defendant will have to complete his first sentence before beginning his second sentence. As a result, the defendant will have to serve at least 40 years in the penitentiary before being eligible for release on parole.”

Mosley, who lived at a residence between Floyd and Merit, was the subject of a reported investigation by the Hunt County Sheriff’s Office after deputies received information on Oct. 10, 2008 of possible child pornography on a videotape that had been brought to the agency. Officers with the Criminal Investigation Division were contacted and reportedly determined the aggravated sexual assault of a child had occurred. During the investigation, the Hunt County Sheriff’s Office requested assistance from the Collin County Sheriff’s Office, the Plano Police Department and the Federal Bureau of Investigation (FBI) in locating additional potential victims and the recovery of computer equipment for evidentiary purposes.

Walker credited First Assistant District Attorney Steve Tittle for the prosecution of the case, and the sheriff’s office for the investigation, most notably Sheriff’s Investigator Jeff Haines, who obtained admissions from Mosley during his interrogation of the defendant.

Blake Hauss Arrested for Child Porn


An 18-year-old Lake City man was arrested on child pornography charges Thursday. Columbia County sheriff's deputies said they've been watching Blake Hauss download child pornography onto his personal computer for six months.

According to the Columbia County Sheriff's Office, during its investigation detectives located a computer that was downloading and offering to share child pornography online.

The investigation of the computer led officers to a residence on Howard Street. During a search of the home, the computer and other computer-related items were seized.

The seized items will be sent to the Florida Department of Law Enforcement’s crime lab for further examination.

Hauss was arrested on two felony counts of sexual performance of a child. He is being held in the Columbia County Detention Facility with no bond.

William McCaffrey Arrested for Child Porn

A local man who helps save lives may have had a dark side. 51-year-old ER nurse, William McCaffrey of Sparks, is in jail after detectives raided his home and found up to one million pieces of child pornography.

Washoe County Sheriff's Detectives downloaded the porn over the Internet on Tuesday from McCaffrey's home computer. After his arrest, they found that his child porn collection was bigger than they thought, and he may have had plans to expand it even further.

Described as a 'friendly guy who likes to keep to himself,' neighbors of 51-year-old William McCaffrey say they never suspected a thing.

"Not in a hundred years. You just don't think of things like that. I'd see him in the mornings heading home from work and he'd wave. There was no sign of it," said Marcia Jenkins who lives next door.

Court documents show McCaffrey lived at a home on Capurro Way In Sparks, and worked in the emergency room at Saint Mary's hospital. Neighbors say he shared the home with his brother and his handicapped mom.

Detectives say evidence taken from McCaffrey's home included images and videos of little girls as young as three years old engaged in sexual acts with adult men.

"There are kids here, there, running back and forth everyday. I never saw the guy looking at them or anything, so I thought everything was as normal as could be," said Marcia's husband, Johnny Jenkins.

Detectives who interviewed McCaffrey say he had become 'desensitized', and had been increasingly interested in looking at child porn. They say he'd also been copying the photos to DVD's and hard drives, and may have had plans for distribution.

McCaffrey described himself as an amateur photographer, and when detectives asked if he'd consider contacting children himself, he said, quote: "I can't predict the future."

Neighbor Rafael Vasquez says he's disturbed to hear that his six-and-nine year old daughters have been walking past McCaffrey's home for months. His little girls mean the world to him, and he says it's a good thing McCaffrey didn't touch them.

"Well you'd be interviewing me from a jail cell because he'd be a dead man," said Vasquez.

McCaffrey faces five counts of possession of child pornography, plus one count of promotion of the sexual performance of a minor. He's being held in the Washoe County Jail on $75,000 dollars bail. A phone message left at McCaffrey's home number, was not immediately returned.

Detectives say there could be more charges filed in the future. McCaffrey's computer files and other evidence is still being sorted through, but they're hoping the public might know more. If you have any information that could help in the investigation, contact Secret Witness at 322-4900.
