Sidney Man Arrestd for Sexual Assault Against 12-year-old

A 35-year-old Sidney man remained in the custody of the Cheyenne County Jail Monday morning after appearing in Cheyenne County Court for presentment on a felony child sexual assault charge, officials said.

It is the policy of The Sidney Sun-Telegraph that a local suspect in a sex assault case not be named unless he is proven or pleads guilty.

The man was arrested in his home last Thursday by the Sidney Police Department after investigators learned of the alleged act. Police Chief Larry Cox said a family friend was notified by the alleged victim who then informed authorities.

Court documents state the victim, a 12-year-old Sidney girl, was interviewed by authorities. She said the inappropriate touch occurred while she was being tickled by the suspect. The document said the girl gave a graphic description of the act.

The man, who denied inappropriately touching the girl at first, later claimed the touch was an accident while tickling the girl and her sister.

The Cheyenne County Attorney’s Office has filed a Class IIIA felony charge of third-degree sexual assault of a child. The charge states that the suspect, being older than 19 years old, subjected a child under the age of 14 to sexual contact but did not cause serious personal injury to the victim.

The maximum penalty for a Class IIIA felony is five years imprisonment, or a $10,000 fine, or both. There is no minimum sentence for the charge.

County Attorney Paul Schaub said a preliminary hearing has been scheduled for July 9 at 1:30 p.m. The man’s bond was set at 10 percent of $100,000.

Evan Ortiz Arrested for Sexually Abusing 14-year-old

A city man was arrested Friday afternoon for allegedly sexually abusing a 14-year-old girl and endangering the welfare of a 10-year-old girl.

Evan Ortiz, 51, of the 500 block of Sharp Street faces two counts of endangering the welfare of children/third degree and one charge of criminal sexual contact/fourth-degree.

Cumberland County Prosecutor Ronald Casella said Monday the sexual contact charge is in connection with the 14-year-old girl.

The endangerment charges are for both girls.

Casella said Ortiz is familiar with the two girls in the case. The time period for the alleged was November 2007.

Superior Court Judge John Waters set bail at $35,000 for Ortiz. He was taken to county jail.

The next step is to present the case to a county grand jury.

Casella said Ortiz could face a total of five to 10 years on the charges, if convicted.

Eugene Shier Arrested for Taking Naked Pictures

Alarming allegations from a teen who says years ago a man touched him and took naked pictures while he was bathing. Austin police arrested 61 year old Eugene Shier and charged him with indecency with a child.

Shier was convicted of sexual assault of a child back in 1994.

Neighbors tell KEYE TV they weren't surprised when police pulled up to the home of Eugene Shier, also known as Bill. Some in the North Austin community where he lives circulated a notice that the man who stayed at the address was a registered sex offender.

Police say a teen told them several years ago, Shier touched him as he bathed with a friend at Shier's home. We're told Shier kept his house stocked with things children love to play with.

"He had things outside swimming pool, he had video games and so forth, and a lot of neighborhood children went and visited Mr. Shier on a regular basis during this time period several years ago," says Austin Police Detective Brett Bailey.

The arrest affidavit says Shier remembers an occasion where the boy and his friend were bathing and according to the affidavit, Shier took pictures of the two naked in the tub. Those who work with alleged abuse victims say it's not uncommon for older children to cry out they've been touched inappropriately years later. Experts say when the alleged abuse first happens it may be viewed differently by a child than an adult.

"I actually work with adults sometimes and many adults who tell me they're in their 60's and 50's and they've just told their family members," say Austin’s Center for Child Protection Director Sandra Martin.

The affidavit says Shier kept knives and swords in his bedroom that children would play with. Although Shier is a registered sex offender, police tell us he was not required to stay away from children.

Police are worried there could be more alleged victims out there and they're asking parents who know Shier to talk to their kids. If you know someone who may have been abused you're ask to call the APD child abuse hotline at 976-6880.

Michael Lovriem Arrested for Molesting 2 Children

A home break-in in the middle of the night has led to the arrest of a suspected child molester and authorities have relatives of the victim to thank for capturing the suspect. Authorities say the burglary and assault happened early Tuesday morning, in a quiet neighborhood near Wonder Valley Ranch. "I'm shocked. You don't expect that to happen around here. That's not what we moved up here for," said neighbor Roger Landucci.

Investigators say 32 year old Michael Lovriem broke into a home on Live Oak Drive early Tuesday morning and molested two young children while the family slept. "During the assault, one of the older brothers woke up and had seen Lovriem kneeling over one of the children. He basically alerted everyone else in the family and Lovriem tried to run out of the house," said Fresno County Sheriff's Dept. Spokesperson Chris Curtice.

Deputies say the victims' brother and father chased and caught Lovriem in front of a neighbor's house, where they held him until deputies arrived. "They did the right thing. Granted, we don't want someone to put themselves in harm's way. However, if it was my daughter or my son, I'd chase them down. I think most parents would do that," said Curtice.

Neighbors describe Lovriem as developmentally disabled and say he had been seen wandering around the neighborhood, even peeking into vacant homes. Still, they never thought he'd be capable of such a disturbing crime.

"He is lucky. He is lucky he got out of there the way he did. Because if it would have been someone else, he'd been down ... If someone breaks into my home, I couldn't guarantee their life," said Landucci.

Michael Lovriem is facing felony charges of burglary and sexual assault but the investigation continues, and deputies say more charges may follow.

Pastor Steve Richardson Charged with Possession of Child Porn on Church Computer

A former Texas pastor who admitted having more than 600 images of child pornography on his church computer has been sentenced to 17 years in prison.

The U.S. attorney's office in Dallas says 36-year-old Steve Richardson was sentenced Monday by U.S. District Judge Sam A. Lindsay.

The former pastor of First United Methodist Church in Royse City pleaded guilty in March to one count of transporting and shipping child pornography and one count of possession of child pornography.

Prosecutors say Richardson sent a sexually explicit image of a child to an undercover federal agent in Seattle and requested comparable images.

Susanne Means Accused of Burning Boy with Cooking Pan (FOUND NOT GUILTY)

A longtime Allen teacher stands accused of using a cooking pan to burn the buttocks of a 14-year-old disabled boy in early 2008.

A Collin County grand jury indicted Susanne Means earlier this month on a charge of injury to a child, a first-degree felony.

The indictment says she knowingly caused serious bodily injury to the boy, using a cooking pan and also an unknown object. The incident is alleged to have occurred at Lowery Freshman Center, an Allen ISD school.

Means denied harming the boy when interviewed by police on March 13, 2008, a police affidavit shows.

She could not be reached Monday.

Means, 45, was a special education teacher at Lowery when the allegation surfaced in early March 2008.

She was reassigned from classroom teaching on March 12, 2008, and worked in the administration building in the last school year, said Kent Turner, chief human resources officer for Allen ISD.

Turner said Means resigned from the district earlier this month. She had worked for Allen ISD since 1997.

An Allen police affidavit filed on July 9, 2008, says Means caused burns to the boy, and describes him as "mentally challenged."

The affidavit says the boy's father became aware of the boy's injuries in early March 2008 and took him to a physician.

The physician found a 12-inch diameter "scald" in a circular pattern on the buttocks. The boy later told an interviewer that the teacher applied a hot pan once to each of his buttocks, the affidavit says.

The investigating officer found her classroom included a kitchen that had a stove and "various cookware," the affidavit says.

The affidavit also says Means failed a polygraph test administered by a U.S. Secret Service agent.

Means was booked into the Collin County Detention Center on July 30, 2008, and posted bail the same day. An Allen police spokeswoman said she did not know why nearly a year passed before the grand jury returned an indictment.

""QUOTE":
Susanne Means was found NOT GUILTY today. You may verify this through the Crimes Against Children Court of Collin County, Texas.  Furthermore, a family friend most likely coached the victim to falsely name Mrs. Means who was a dedicated and compassionate special education teacher for years. This false accusation has caused her family over 3 years of unimaginable anguish and suffering, has cost them tens of thousands of dollars, and ruined the retirement she worked so hard towards. Worst of all, because of this careless, baseless and evil accusation, she understandably has no desire to teach again. That is a damn shame for the many children who would have had a wonderful teacher."

Marvin Manganaan Arrested for Sex Crimes

A 32-year-old youth racquetball coach has been arrested on suspicion of sex crimes against children, and investigators are calling for possible victims to come forward.

Officer Pete Smith, a police spokesman, said that last week a boy reported that Marvin Baclig Manganaan, 32, had tried to persuade him to take inappropriate photographs. The boy refused and went to police, who then served a search warrant at Manganaan’s home.

Smith said during the search investigators learned Manganaan had frequent contact with children in his role as a coach of competitive youth racquetball. Smith said police also found photographs and video depicting Manganaan molesting children.

“Until we identify the juveniles in all of those still or moving pictures, we don’t have any more details,” Smith said.

The Police Department has established a dedicated hotline for victims to contact investigators. Anyone with information is asked to call the Stockton Police Department at (209) 937-7091.

“We saw the potential there for a lot of people either wanting to provide information or to come forward,” Smith said. “We wanted to have a fluid channel of contact.”

Manganaan is being held in the San Joaquin County Jail on $1 million bail. He was booked on suspicion of contacting minors with the intent to commit a sexual offense, possession of child pornography and using a minor to perform prohibited acts. He was scheduled to appear in court today.

Justin Shine Charged with Kidnapping and Attempted Rape of 6-year-old

A man lured his son's 6-year-old friend to an apartment with a promise to show her some pet gerbils, then bound her with tape and leg shackles, injected her with an unknown substance and tried to rape her, but she fled while still chained, authorities said Monday.

Justin Shine, 26, was charged with kidnapping, attempted rape, assault and battery with a dangerous weapon — a hypodermic needle — and resisting arrest.

At his arraignment Monday in Hingham District Court, a prosecutor described in chilling detail what happened after the girl went out Saturday to ride her bike in front of her apartment in Hanover, a middle-class suburb just south of Boston.

Shine was ordered held without bail pending a dangerousness hearing Wednesday. Not guilty pleas were entered on his behalf.

Assistant District Attorney Sharon Donatelle said the girl told police that Shine, who lived in the same apartment building, saw her outside and yelled out his window, inviting her to see some gerbils. The girl knew Shine as the father of a little boy she often played with in the apartment complex.

Once inside, Shine showed the girl the family's gerbils but then bound her hands with tape, put tape over her mouth, wrapped her arms with a "fishnet-type material" and shackled her ankles with a chain, Donatelle said.

The girl told police that Shine injected her in the hip using a syringe and that she felt "somewhat sleepy" afterward. Donatelle said the syringe is being tested to find out what was in it.

The girl said that after she heard knocking on doors, Shine got a knife and cut the tape off her hands. She said she was crying and Shine told her to "shut up."

"He also told her that she was not going to die today — that he was," Donatelle said. He later let the girl leave, she said.

The girl fled the apartment as police were going door to door looking for her. A man at the complex found her and carried her to police. Her feet were still shackled together, and her arms and legs had blood on them. Police later determined that the blood on the girl was Shine's blood.

"She was very upset and crying," Officer David Zemotel wrote in a police report. "I asked her what had happened and she stated, 'The man took me.'"

The girl then showed police Shine's apartment, Donatelle said.

Police said they arrested Shine after finding him in a bedroom, covered with blood. He had an open wound on his left wrist.

Zemotel said he hit Shine on the head with his gun after Shine ignored police commands and lunged toward officers. Shine had a black eye when he appeared in court Monday.

Police said they found the girl's pink bicycle and Barbie bike helmet in his apartment.

Donatelle said that while Shine was being treated at a hospital, he told a state trooper that he had lured the girl into his apartment and bound her and admitted "he had plans to engage in some sexual activity" but had "second thoughts."

He said he had injected himself with cocaine but didn't admit injecting the girl with anything. He told the trooper it may have been by accident, Donatelle said.

Plymouth District Attorney Timothy Cruz said the girl was taken to a hospital but had been released.

"She escaped, and we hope she's going to be OK, but I'm sure it's going to be a long road for her," Cruz said.

The girl's mother told police she let her daughter ride her bike outside while she put her son down for a nap. When she didn't hear her outside about 20 minutes later, she went outside to look for her, then called police.

Shine looked down and did not speak during his arraignment, except to accept the judge's offer for a court-appointed attorney, William Leonard, who declined to comment to reporters.

Sexual Abuse Prevention Education

One in four girls and one in six boys will be sexually abused before they reach eighteen. That is why there is a program in Idaho Falls that wants to educate leaders and other adults to try to prevent and stop sexual abuse of kids.

The program shows videos of survivors who tell their stories of being abused by friends and family members.

The instruction also shows how to prevent and recognize abuse. It also teaches how to react once the abuse is reported so that the child would only have to be interviewed once by law enforcement and counselors.

Brandi Warnke is a licensed social worker and says that, "The child who discloses sexual abuse is going out on a very scary limb. And so the adult the information is disclosed to has to be aware of how to handle that appropriately, so the child doesn't have to continuously have to face the trauma, over and over and over."

Warnke says sexual abuse is like a silent epidemic and the program helps educate people to make a change in the community.

She hopes to expand the programs to the schools.

During an exchange of text messages with an undercover agent on May 28, 2008, Dorothy claimed to have repeatedly assaulted a 2-year-old girl that he babysat, authorities said.

On June 2, 2008, Dorothy transferred nearly 40 child pornography video files, depicting the sexual assault of children, to an undercover agent, authorities said.

Dorothy pleaded guilty on Jan. 26 before U.S. District Judge Gerald Rosen and received the maximum sentence today.

Teachers Robert Rich & Adam Windsor Charged with Inappropriate Behavior with Students

Two local teachers face criminal charges amid allegations of inappropriate behavior involving female students at their schools, the Frederick County State's Attorney's Office said Friday.

A Catoctin High School teacher is accused of inappropriately touching a 17-year-old female student, authorities said. A Ballenger Creek Middle School teacher faces allegations he videotaped 13- and 14-year-old girls as they changed clothes.

A grand jury on Friday indicted the men, both Hagerstown residents, said Assistant State's Attorney Lindell K. Angel. Warrants will be issued for their arrests.

If convicted of the most serious offenses with which they are charged, Robert Rich, 47, and Adam Windsor, 25, could each face 25 years in the Maryland Division of Correction.

Rich, a science teacher at Catoctin High, has been employed by Frederick County Public Schools since January 2004, said Marita Loose, the school system's communications director.

Rich was accused of having an inappropriate relationship with a student. He was indicted on six misdemeanor counts of fourth-degree sex offense and one felony count of child sex abuse on school property, Angel said.

An investigation by Detective Michael Davies of the Frederick County Sheriff's Office began after the teen victim confided her allegations to a family friend, who told the girl's parents.

Windsor, the theater arts and band teacher at Ballenger Creek Middle for three years, became the focus of an investigation by sheriff's Detective Willie Ollie as an offshoot of an investigation by the Baltimore office of U.S. Immigration and Customs Enforcement, Angel said.

Executing a search and seizure warrant of Windsor's residence as part of a child pornography investigation, ICE agents found video footage on his computer taken at Ballenger Creek Middle, Angel said.

Windsor is accused of using a cell phone to videotape girls changing in a room set up for costume changes, Angel said.

The ICE agent assigned to the pornography case was not available Friday.

The grand jury indicted Windsor on two counts of child sex abuse, exploitation and two counts of visual surveillance with prurient intent, authorities said.

Both teachers were placed on administrative leave when school officials became aware of the police investigations, Loose said.

Rich has been on administrative leave since May 6; Windsor has been on leave since April 24.

"School administrators were directed by law enforcement not to share information about these matters with staff or the school community while the investigations were ongoing," Loose said.

Court Doubles Man Sentence Who Sexually Abused His Daughter for 13 Years

VANCOUVER

A B.C. Court of Appeal has more than doubled the sentence of a man who sexually abused his own daughter for 13 years.

A panel of three judges unanimously decided the man was afforded too much compassion when he was sentenced in 2008 to two years in prison for the prolonged abuse.

The panel sentenced the man — referred to as O.M. to protect his daughter’s identity — to five years in prison.

The acts began when the child was two years old and continued until she was 15. The abuse progressed to sexual intercourse by the time the girl reached six years of age. The girl reported that between the ages of 11 and 14, her father abused her on average five days a week, three weeks out of the month.

O.M. pleaded guilty and showed genuine remorse, according to court documents.

In the 2008 trial, the judge noted O.M., who had been abused as a child himself, felt genuine remorse and was willing to pursue therapy.

But the appeal court judges, in a ruling last week, said the original conviction didn’t consider the length of time he had abused his daughter.

In their decision, the judges also considered the age of O.M.’s daughter was first subject to the abuse, and that this was his second conviction.

O.M. began the sexual abuse of his daughter before the end of the probationary period for the first offence.

The panel said the sentencing judge in November 2008 was so “moved by compassion for his antecedents and impressed with his steady work record and commitment to therapy, she chose a sentence at the low end of the range.”

His sentence of two years less a day was “an unsatisfactory response to an egregious crime and is . . . unfit,” it continued.

O.M. “needed to protect his daughter, not give way to his deviant impulses, and to make every effort to bring the cycle [of abuse] to an end,” they continued.

“There must have been many times throughout the 13 years of abuse that the respondent’s conscience troubled him, yet he persisted.”

Norman Richardson Arrested for Sexual Assault to 6-year-old

A Wheeler man pleaded not guilty to second-degree sexual assault of a child in Dunn County Circuit Court June 22.

Norman W. Richardson, 40, allegedly fondled a 6-year-old girl that his daughter was baby sitting in his home on Feb. 13.

According to the criminal complaint, the victim woke up and found herself in the defendant’s bed, unclothed from the waist down, being touched inappropriately by the defendant.

After trying unsuccessfully to push him away, she allegedly got away from Richardson on the pretext of having to go to the bathroom. The girl reportedly found Richardson’s daughter and told her what happened.

Richardson was on probation for misdemeanor battery and disorderly conduct at the time of the alleged assault. According to the criminal complaint, Richardson’s terms of probation include no drinking or drugs. He admitted to having “three of four beers” by the time his daughter began baby sitting.

Richardson is currently being held at the Dunn County Jail. His next court appearance is scheduled for Aug. 18.

Darrin Shipley Arrested for Sexually Assaulting 4-year-old

PEKIN, Ill.

A Pekin man was charged Friday in 10th Judicial Circuit Court with sexually assaulting a 4-year-old girl.

Darrin S. Shipley, 42, of 208 Parkway Drive, Pekin, was charged with predatory criminal sexual assault, a Class X felony, and aggravated criminal sexual abuse, a Class 2 felony.

The child was interviewed at the Champaign County Children’s Advocacy Center where she showed what had happened to her with an anatomically correct doll, court records said.

One of the victim’s brothers was also interviewed at the advocacy center. He said he saw the man show the pornography to the victim and sexually assaulting her.

Shipley denied the allegations when interviewed by Pekin police, but stated that the girl is “trustworthy and a 4-year-old would not just make this up.”

Shipley was arrested and taken to the Tazewell County Justice Center where he remains under a $250,000 bond.

Keven Grisham Sentenced to 229 Years for Sexual Assault

A man convicted of sexually assaulting three Porterville-area girls, one of him his stepdaughter, faces a prison term of up to 229 years when sentenced next month, the Tulare County District Attorney's office announced Friday.

Keven Grisham, 52, of Santa Maria was convicted June 18 by a Tulare County Superior Court jury. He was found guilty on 21 counts of sexual assault, including child molestation, forcible rape and sodomy, and unlawful sexual intercourse with a minor, according to the press release.

Prosecutors said the offenses occurred between 1996 and 2003, when Grisham was living in the Porterville area and when the three victims, now in their early- to mid-20s, were minors.

Grisham's arrest, in Santa Maria in October last year, followed a monthlong investigation that began after a then-23 year-old woman told Tulare County sheriff's deputies that Grisham, her stepfather, had sexually assaulted her between the ages of 11 and 18, according to a sheriff's report.

During the investigation, two other victims approached the sheriff's department and told deputies they had been sexually assaulted by Grisham when they were minors, said Deputy District Attorney Mikki Verissimo, who prosecuted the case.

The assaults occurred in the Porterville area, Verissimo said.

"I'm very happy with the verdict and I'm happy that we got justice for the three victims," she said.

Grisham will be sentenced July 22 in Tulare County Superior Court.

Duke University Director Frank Lombard Charged with Offering Son For Sex

A Duke University official has been charged in federal court with offering his 5-year-old adopted son up for sex. Frank Lombard, associate director at the university's Global Health Institute, was arrested Wednesday in Raleigh, the FBI said.

In an undated photo provided by the Durham County Sheriff's Office, Frank Lombard is shown. The Duke University official has been arrested and charged with offering his adopted 5-year-old son for sex. Authorities said that Lombard tried to persuade a person, who he did not know was a police officer,to travel to North Carolina to have sex with Lombard's child.

An unidentified informant who already faces child porn charges in a different child sex case pointed investigators to Lombard, according to court documents. The informant told investigators he had met Lombard on the Internet four years ago. The informant described in graphic detail how he allegedly observed Lombard molesting an African-American child on four occasions over an Internet video chat service called ICUii.

The informant said, according to court papers, that Lombard, who is white, said that he lived in the Raleigh-Durham area of North Carolina and that the child was one of two adopted African-Americans in his custody.

Lombard has been charged with attempting to induce someone to cross state lines to engage in sex with a child, punishable by a maximum sentence of 20 years in prison.

Lombard allegedly used the adult Internet service to conduct his video chats. According to an affidavit in support of the arrest warrant, the Internet service indicated that Lombard's profile "stated he was interested in "perv fam fun," a reference to "incestuous child molestation." The service also told investigators that a customer service complaint had been sent to the company in January 2007. A customer who had chatted with Lombard complained to the company that Lombard said he was "into incest" and had adopted two African-American children, court records said.

A Washington, D.C., police detective who was investigating the case set up undercover chats with someone matching Lombard's description during which the detective says he was invited to fly to Raleigh to have sex with the person's 5- year-old adopted child. In his affidavit, Det. Timothy Palchak wrote that he engaged in a chat with someone using the screen name "FL" who provided nude pictures of himself. The pictures matched Lombard's North Carolina driver's license photo, according to the affidavit.

During the chats, according to the affidavit, "FL" told undercover investigators that he had himself molested his child, whom he adopted as an infant, and that he had allowed others to molest his child. "FL" stated that "the abuse of the child was easier when the child was too young to talk or know what was happening, but that he had drugged the child with Benadryl during the molestation," Palchak wrote in his affidavit.

Casey Todd Arrested for Molesting & Battering His 2-month-old Baby

The Carroll County Sheriff Office says a 2-month old baby who was sexually molested and battered by her father, has been released from the hospital. Chief Deputy Brad Robinson says "The baby is expected to make a full recovery." Robinson says the baby is in the custody of the Department of Family and Children Services.

The baby suffered a fractured skull and a broken leg. Casey Todd, 27, of Carroll County was charged with Aggravated Child Molestation, Aggravated Battery and First Degree Child Cruelty. He was arrested on June 15th. Six days prior to the alleged abuse, the baby's mother talked about her concerns for how her husband was treating the baby on-line.

On momslikeme.com, the baby's mother expressed her concerns about her daughter's well-being. Atlanta's Momslikeme.com web site is owned and run by 11Alive's parent company Gannett.

We are not identifying the mother or her daughter for their protection.

On June 9th the mother wrote: "Help me please my daughter is not even two months and she's has already had little bruises on her arms and legs and back. Her daddy is really rough with her. And every time he picks her up she screams and don't stop."

"I've talked to him and told him if I seen one more bruise on her he's gone and he's doing much better with her, but she still screams, I still think he hurts her but I don't see anything."

But one day later the mother backed off the serious nature of her first post and wrote: "Well I think he's just a little rough with her. There not like blue or black bruises but there little red ones. I know he's not doing it on purpose."

"I asked the doctor if she bruises easy and she said its possible."

"Thanks for everything everybody I really appreciate it."

The Carroll County Sheriff Office says Todd's own mother questioned how her son treated his daughter, but said she never would have expected what allegedly happened.

On the same day the baby's mother posted her concerns, she also entered her husband into a photo contest on the moms like me website. The baby's mother posted a picture of Todd holding his baby daughter. The mother called him "The greatest dad ever."

Walter Earl Taylor, 39, of Lake City, has been charged with sexual battery on a person under 12 by a person under 18.

The charge stems from a 1983 cold case that Boynton Beach police senior investigator Toby Athol helped solve.

Taylor, who is being held in the Palm Beach County Jail without bail, already has served almost 14 years for raping another child.

He was released in 2001 after serving that term.

5-year-old Dies from Blunt Force Trauma by Christopher Mack

A preliminary autopsy report reveals 5-year-old Sincear Kirven of Mexia died of blunt force trauma.

Arrest warrant affidavits state that the boy was beaten to death Sunday by his uncle, who struck the boy and his 3-year-old brother repeatedly with a belt.

Christopher Mack, 22, was arrested Monday in Limestone County, and is being held in jail there on charges of capital murder and aggravated assault in lieu of $1.5 million bail.

Andrea Shante Thomas, 24, the woman with whom Mack was living, also was arrested on those charges Monday, and is being held in the McLennan County Jail in lieu of $525,000 bail.

Sincear, his 4-year-old and 3-year-old brothers, and 7-year-old sister were staying with their uncle, who was visiting his girlfriend, Thomas, at her apartment on 1708 E. Crest Drive in Lacy-Lakeview, the affidavit states.

Marissa Gonzales, a spokeswoman with Child Protective Services, said the four children live in Mexia with their mother, Brandi Mack, and their great-grandmother.

After the beatings, CPS officials placed the three remaining children in foster care until a hearing is set to determine otherwise, Gonzales said.

According to Limestone County court records, Mack was convicted in March on a charge of abandoning/endangering a child and evading arrest. He was sentenced to probation, records show.

Just before midnight Sunday, Lacy-Lakeview police were dispatched to Providence Health Center in connection with the alleged beatings.

Mack had driven Sincear to the hospital, and told doctors that the boy collapsed in the apartment.

The affidavit states Sincear had “extensive visible injuries” including “bruises, abrasions and lacerations to his head, arms, front and back torso and legs.” The injured child was brought to the hospital by another family member, the affidavit states, and was said to have suffered similar injuries.

Police later learned from talking with witnesses that Mack had repeatedly beaten the boys with a belt. The affidavit states that Sincear was beaten until “he passed out and was not moving.”

According to the affidavits, Thomas was present at the time of the beatings, and did nothing to stop it, call the police or seek medical attention for the boys.

Medical staff told police that Sincear had been dead about an hour at the time when he was brought in by his uncle. The injured child has been treated for his injuries and released from the hospital, according to a news release issued today by the Lacy-Lakeview Police Department.

It is unclear why Mack, who is reportedly from Mexia, and his nephews were staying in Lacy-Lakeview. The news release states that Mack was watching the boys for the Mexia-based family.

An autopsy has been ordered on Sincear’s body.

Officer Mark Benton Arrested on Sexual Abuse Charges

Oregon State Police arrested an Athena police officer Monday on charges of sex crimes.

Athena Police Officer Mark Benton Ashcraft is in the Umatilla County Jail on charges of third-degree sodomy, second-degree sexual abuse and first-degree online sexual corruption of a child. The first two charges are Class C felonies in Oregon and the last is a Class B felony. Ashcraft has jail bonds totalling $22,500.

According to the Oregon Revised Statute, the charge of first-degree online sexual corruption means a defendant reasonably believes the victim to be under 16 years of age and "intentionally takes a substantial step toward physically meeting with or encountering the child. That step includes arranging a place and time to meet. The crime is punishable by up to 10 years in prison and a fine up to $250,000.

Dyann Swanson, Athena city recorder, said city officials are concerned about the matter, but it's also important to keep in mind Ashcraft is only a suspect at this time.

Ashcraft was a police officer in Pilot Rock for nine years before the smaller city of Athena hired him in December 2007. Swanson said while he was with Athena he had been a good employee.

"He came with a really great record," Swanson said.

Pilot Rock Mayor Virginia Carnes declined to comment on the case.

Lt. Greg Sherman with the Oregon State Police in Pendleton said Umatilla County District Attorney Dean Gushwa was handling all inquiries about the arrest.

Russell Christie III Sentenced to 90 years for Distributing Child Porn

When Russell Christie III was convicted last November of moderating and posting images to website that distributed child pornography, he was facing a 30-year prison term.

But today, after listening to testimony from a woman who said she had been molested by the former Sussex County school bus driver for nearly a decade when she was a child, a federal judge in Newark tripled the sentence, ordering Christie to serve 90 years behind bars.

In imposing the sentence, U.S. District Court Judge Harold Ackerman said he wanted to make sure Christie would never harm another child and also send a message to others who would try to sexually abuse or exploit a child.

Ackerman said he was mindful not only of the abuse the woman said she had endured, but also of the children depicted in the images Christie, 51, helped distribute around the world.

"The defendant's cheap thrill came at a considerable cost," Ackerman said. "The thousands of nameless children that appear in his images now strive to have a semblance of life."

Christie, who also worked at the Green Valley Beach Campground in Newton, was arrested in 2006 and charged with moderating a website that trafficked in child pornography. Prosecutors say the site had several hundred members worldwide.

He was convicted late last year and under federal sentencing guidelines, faced 30 years in prison.

That was until the woman, identified by prosecutors as "Victim 1," was allowed to testify today. Prosecutors maintained that that woman's testimony would establish a pattern of behavior that would warrant a life sentence for Christie.

The woman, now 28, said her encounters with Christie began when she was 9 and lived next to the campground. She said he would invite her to his home to play video games - invitations, she said, that at the time seemed innocent.

But the video game sessions soon turned to fondling, she said. By the time she was 12, Christie was plying her with alcohol and drugs in order to have sex with her and to take nude photographs of her, she said.

When her contact with him ended when she was 19, the woman said, she was heroin junkie who would travel to Newark and Paterson to buy drugs with money and transportation Christie provided in exchange for sex, she said.

"He turned me into a drug addict - a lot of hurt, a lot of pain," said the woman, who broke down several times on the witness stand. "It has destroyed any relationship that I could have with any man."

Ackerman overruled arguments by defense attorneys that Christie was never convicted for having sex with an underage victim, but rather for possessing and distributing child pornography, and making 2,500 posts to the website between October 2005 and July 2006. The posts, authorities said, depicted images and stories of children engaged in sexual acts with adults.

The judge said Christie was a unique convict, who was not just a mere voyeur of downloadable images, but also acted out the sexual deviance he was viewing.

"This court has a solemn duty, not only in dealing fairly with Mr. Christie, but in dealing fairly with the testimony of a young woman who obviously went through things that she'd rather forget about," Ackerman said, glaring at Christie and pointing his finger at him. "I will not be blind to the severe misconduct that appears before me today."

Assistant U.S. Attorney Lee Vartan said that without the woman's testimony, Christie would have been sentenced to a maximum of 30 years. Her story, Vartan said, established for the court a pattern of sexual abuse and exploitation against a minor that the judge was able to consider when imposing sentence.

Under cross-examination by defense attorney Lorraine Gauli-Rufo, the woman admitted she never told anyone about the alleged abuse. Gauli-Rufo also tried to strike at her credibility based on her history of drug use, criminal record, a teenage pregnancy (not by Christie) and that she had not reported the abuse after Christie was charged.

Vartan said Christie was the root cause of the woman's behavior, and that he admitted to authorities that he had had sexual contact with the victim.

Christie was one of 22 people in 20 states arrested in July 2006 as part of an FBI child pornography sweep called "Project Safe Childhood."

Thousands of pornographic images involving children were found on his computer and on hundreds of digital CDs that were confiscated by authorities, Vartan said.

None of the images was of the woman who testified today. She said Christie began photographing her when she was 12, in various states of undress. The more than 1,000 images of her, however, were taken with a Polaroid camera. Despite a painstakingly thorough search, none of the images were recovered, Vartan said.

Before he was sentenced, Christie asked Ackerman for a new trial, contending that his constitutional rights had been violated. The motion was denied.

Tomas Gonzales Charged with Sexually Abusing 2 Relatives

A church pastor faces multiple felony charges in connection with allegations he sexually abused two female relatives.

Tomás Gonzáles, 61, of Mercedes, was arraigned Tuesday evening in Mercedes Municipal Court on two counts of indecency with a child and eight counts of aggravated sexual assault of a child.

"I committed the error," he said in Spanish during the arraignment. "Now I have to pay for it."

Gonzáles serves as pastor at Templo Nueva Vida in a colonia at the intersection of Lott Road and Dedri Drive in the Weslaco area.

Sgt. Hugo Ramos Jr. of the Mercedes Police Department said a 15-year-old female relative wrote a letter to her mother last week saying that the man had sexually abused her since she was about 5 years old. Eventually, the girl's 13-year-old sister came forward with similar accusations.

Gonzáles was called to the police station Monday night for questioning and provided a voluntary confession to the crimes, Ramos said. "We just called him and he turned himself in."

The pastor allegedly abused the two girls when they visited him at his home, the sergeant said. The sisters are currently receiving counseling.

Investigators said they are following leads that could result in more charges against the man.

"There could possibly be more victims," Ramos said, adding that no incidents have been reported at the pastor's church.

Residents near Templo Nueva Vida said a man in a white truck sometimes picks up children to take them to church services in the evenings, though they were unsure whether that man was Gonzáles.

"There have been rumors about (sexual abuse at) the churches nearby," Margarita Espinoza, 32, said in Spanish. "If one doesn't go with the children, they shouldn't let them go at all."

Across the street from Templo Nueva Vida, about a dozen people gathered to pray in a small, hot warehouse that is home to the Iglesia de Jesucristo - Salvación Eterna.

The group chanted hymns while someone softly strummed along with a guitar.

"I hadn't heard of anything," said Alex Carmona Jr., whose father is a pastor at Iglesia de Jesucristo. "But anytime something happens against children, it's nothing good."

The sound of the chorus hummed through the colonia while a young girl wandered through an abandoned structure in a diaper and several boys rode their bicycles down the gravel road.

"One thinks some people are incapable of doing anything wrong," Espinoza said in Spanish. "But you have to be careful."

Gonzáles is not a registered sex offender and has no prior criminal history, according to available public records.

He remained at the Hidalgo County Jail on Tuesday night in lieu of a $2 million bond. If found guilty of aggravated sexual assault, he could face up to life in prison and a possible fine of up to $10,000.

Bob Bopp Arrested for Sexual Assault

The latest photo of Bob Bopp, the high school hall of fame hockey coach who led Grosse Pointe South to a state championship in 2007, isn't a publicity snapshot or an image captured moments after victory.

It's a blurry mug shot, taken by law enforcement officials after Bopp was booked on suspicion of sexual assault, charges that could land him in jail for the rest of his life.

Bopp, 53, and James McBee, 20, of Highland Township were being held Monday without bond on several felony charges, including raping a 16-year-old Farmington Hills boy in 2007. The men are accused of giving the teen alcohol, showing him pornographic pictures and sexually assaulting him.

Law enforcement officials throughout the region fear there could be others alleging abuse.

Meanwhile on Monday, the Grosse Pointe school district posted a vacancy for the job of Grosse Pointe South varsity hockey coach on its Web site.

Bopp's attorney, Southfield-based Christopher Andreoff, said his client is holding up, but he declined to discuss specifics of the case because he is waiting to see more evidence.

"He's obviously very upset by the charges," Andreoff said of Bopp. "It's very stressful. I told him to have as much patience as he can until we see how this works out."

During a raid of Bopp's home June 16, authorities said they confiscated pornographic images, including videos believed to involve kids. Authorities are now working to identify those in the pictures and on the tapes.

The raid was conducted by federal agents along with officers from the Farmington Hills and Taylor police departments.

Maria Miller, a Wayne County assistant prosecutor, on Monday said: "We would urge anyone with information that may be helpful to the investigation of defendants Bopp and McBee to call their local police."

Parents and team members painted a paradoxical picture of a man fiercely dedicated to his team but also secretive about his personal life.

He was aloof when parents approached him, often avoiding their gaze, even when they came to congratulate him on a good game, one parent said.

'The kids liked him'

"He was very standoffish with parents," said a mother of one team member, who declined to be identified. "He was very hard to get to know, but the kids liked him."

Bryan Sullivan, president of the Michigan Metro High School Hockey League, said Bopp was well-respected and was always advocating for his players to other coaches and nominating them for awards.

Sullivan said several coaches in the league felt a collective guilt for failing to see any warning signs.

"We're all in this for the kids. You don't want to see anything like this happen," said Sullivan, who has known Bopp as a coach for 25 years.

Dan Barry, who took over as president of the Michigan High School Hockey Coaches Association in April 2008, said he was stunned by the allegations.

Barry, the head coach at Warren De La Salle, said he has known Bopp for 16 years.

"He always got the best out of his players," Barry said. "He kept them motivated, and the kids always seemed to like him."

Bopp's preliminary exam is set for June 29.

Meanwhile, Taylor Police Cmdr. Don Helvey said authorities are "bracing for the possibility of other victims."

"That's where we'll do our follow-up -- it's basically waiting to see if anything else comes up from other cases."

Grosse Pointe Schools officials did not return calls Monday to The Detroit News.

'Red flags were ignored'

At a board meeting Monday night, parent Mike Shields told officials his son played on the hockey team for about three years but quit before the end of his senior year because of problems with the coach.

"Red flags were ignored," Shields told the board during the public comments portion of the meeting.

"This issue runs deeper than just the coach."

Bopp started coaching Grosse Pointe South in 1992, amassing a 241-120-12 record before winning the Division II state championship in 2007.

Tony Slone Charged with Sexually Abused Stepdaughters

A long-haul truck driver pleaded not guilty Monday to charges he sexually abused his teenage stepdaughters and fathered one girl's baby.

Tony Slone, 43, entered the plea in Superior Court in Victorville, said Susan Mickey, a spokeswoman for the San Bernardino County district attorney's office.

Slone was charged with sexually abusing his now 13- and 16-year old stepdaughters over the last four years. His wife was charged with child abuse for allegedly letting her elder daughter continue to have contact with Slone after he fathered her 13-month-old child.

Tony Slone was arrested June 4 in Chester, N.Y., where he had traveled for work, and was extradited to California on Sunday. He is a registered sex offender and previously served an eight year-prison sentence for lewd acts with a child.

Prosecutors say they learned of the abuse when a high school student reported reading sexual text messages on her friend's cell phone from her friend's stepfather.

Mickey said an attorney from the conflict panel was appointed for Slone. No one at the panel's offices was immediately available to comment. Slone's next court date is June 30.

Anita Slone, 47, reached a plea deal with prosecutors last week. She pleaded guilty in exchange for no more than 180 days in county jail and five years probation, said Kathleen DiDonato, a deputy district attorney.

DiDonato said the probation would help protect the daughters until they are adults. Anita Slone is scheduled to be sentenced in July.

Bruce Unger Pleads Guilty to Assault on Child

Former Bryan teacher Bruce Unger agreed to a plea bargain Monday morning and was sentenced to 40 years in prison just minutes before a jury was expected to be selected for his trial on aggravated assault of a child charges.

He pleaded guilty to all charges he faced, which also included indecency with a child and bond jumping.

Opening statements were set to begin in the trial Tuesday morning.

Unger once taught fifth grade at Neal Elementary School in Bryan and received national accolades for creating and coaching a soccer team for at-risk youth.

He was arrested on two charges of indecency with a child by sexual contact in November 2006 after police said he fondled two boys.

In January 2007, he was arrested again and charged with three more counts of indecency and one count of aggravated sexual assault of a child after more people came forward with molestation accusations.

His trial first was scheduled for late 2007, but he failed to show up at a pretrial hearing. His father said at the time that he had taken his motorcycle to Colorado to clear his head.

Unger wasn’t heard from again until December 2008, when local officials, FBI agents and U.S. Marshals tracked him to a town outside Kiev, Ukraine. Authorities said he was living there under the adopted name Tylor McCoy and teaching English lessons.

He was arrested and extradited to Brazos County soon after he was located.

The 30-year-old will return to court Monday afternoon to hear statements from his victims.

Christopher Wenzlick Charged with Taking Indecent Liberties with Minor

Following a three-month investigation, a 23-year-old man has been charged with taking indecent liberties with someone he believed was a 14-year-old girl.

Christopher Andrew Wenzlick, of the 500 block of Coral Court, was arrested when investigators served a search warrant on his home Friday, police wrote in a news release. He was charged with three counts of taking indecent liberties with a child and one count of using a computer system for crimes against children.

Police seized twelve computers along with confidential material that belonged to the Navy, the release says. Items that belonged to the Navy were turned over to the Naval Criminal Investigative Service.

Wenzlick is a sailor stationed aboard the carrier Carl Vinson.

Newport News police received a call from police in Kenton, Kentucky in early March, the release says. The complaint was about a man using a home computer to chat with someone he believed to be a 14-year-old girl. The man had sent inappropriate photos and attempted to solicit photographs of the girl. He had sexually explicit online chats with the girl.

17 Arrested for Sexually Exploiting Children

It's a crime that victimizes children and it happens thousands of times a day with the click of a button. We first told you about this story last week when police raided a house in Monument. Now police are up to 17 arrests.

Investigators say they're all men who now face felony charges of sexually exploiting children. "People have a tendency to think it's just a video, it's just a picture," says Sgt. Bill Dehart with the Internet Crimes Against Children Unit at the Colorado Springs Police Department, "the reality is that's a child being abused."

In a week's time, police executed several search warrants at homes across southern Colorado. "We're actually doing onsite forensic examinations, recovering databases," says Dehart of what officers are collecting. It's all part of an extensive investigation called Operation Peerless Summer, referencing the peer-to-peer online networks where people are trading child porn.

"If you're sharing those images, those videos on their computer, anyone can find them," says Dehart. Investigators say the ultimate goal is to put a stop to the production of child porn. They've found no evidence yet of children being abused locally.

"We're talking about protecting children," Dehart says. Investigators say they expect additional arrests and say people who commit Internet child porn crimes could be anywhere. Investigators say telling people the crime is happening is part of the battle to stop it.

"The word is getting out," says Dehart, "we're talking about people actively trading child pornography and it's not something people should do." But people are doing and after so many arrests, officers say the crime crosses geographical and socioeconomic boundaries.

"There is no profile where this person is the one, we need to look at," Dehart says. Investigators say they know where to look and how to find out who's trading child pornography online. They say you should be just as aware of what's arriving on your computer.

"You suspect somebody has these images on a computer, it's the old adage, you'll know it when you see it," says Dehart. Investigators say many of the offenders have several hundred images on their hard drives. "You're looking at the memorialization of abuse and it's illegal to possess," says Dehart of online child porn.

Investigators say it's important to talk with your kids about what's appropriate and what's not online to make sure your children don't become victims.

Art Arnold Weller Charged with Exchanging Child Porn

An Ocean Shores restaurant cook who got deferred prosecution on a child molesting charge 25 years ago was sentenced Monday to five years in prison for receiving child pornography.

According to documents filed in U.S. District Court in Tacoma, 49-year-old Art Arnold Weller came to the attention of FBI agents investigating the exchange of child pornography through peer-to-peer file-sharing technology.

Agents wrote that they found 2,967 pornographic still images and 301 videos on his computer in January 2008, many showing children younger than age 12.

Assistant U.S. Attorney Michael Dion writes that while Weller was not accused of child molesting after the case a quarter-century ago, the pornography episode shows " he has failed to get his demons under control."

Richard Minifie Pleads Guilty to Possession of Child Porn

A Woodinville health-insurance consultant faces up to 10 years in federal prison after pleading guilty to possessing child pornography.

Richard L. Minifie, 44, changed his plea this morning in U.S. District Court in Seattle. Sentencing was set for October. He remains in custody.

Minifie was arrested June 5 at his Woodinville home by U.S. Immigration and Customs Enforcement agents, who investigate Internet pornography cases. Prosecutors said he had about 600 explicit images on his computer.

Investigators first learned of Minifie's activities in March 2008 when they arrested a Virginia man and found evidence on his computer that he had traded hundreds of images online with Minifie.

After his prison term, Minifie will be on probation for 20 years and will have to register as a sex offender, prosecutors said.

Karl Allen Dreyer Sentence to Life for Aggravated Sexual Assault

Just a few hours after convicting Karl Allen Dreyer of Aggravated Sexual Assault of a Child, a Montgomery County Jury recommended a life sentence in the case. Judge Kathleen Hamilton of the 359th District Court followed the jury’s recommendation and imposed the sentence Friday evening.

The defendant was convicted of violently raping his wife’s 15 year old step-sister. Prosecutors Rob Freyer and Echo Coleman walked the victim through the violent sexual assault, and also presented evidence of another sexual assault perpetrated by this same defendant years earlier. Sheriff’s deputies from the Montgomery county jail testified that the defendant was a behavioral problem in the county jail, and an officer from El Paso testified that after fleeing from this jurisdiction after the most recent sexual assault, the defendant had to be tased when he became violent with officers attempting to arrest him.

The defendant had a prior prison trip for Burglary of a Habitation and several misdemeanor arrests. The jury sentenced the defendant to life after 30 minutes of deliberation.

“I am once again glad that a victim was able to leave a Montgomery County courtroom knowing that the citizens of this county heard their cry for help,” said District Attorney Brett Ligon. “This is prosecutor Rob Freyer’s fifth life sentence from a jury since coming to work for this office in January. He continues to distinguish himself as a champion for those that unfortunately fall victim to these sadistic predators. Juries continue to call for maximum sentences in these cases,- and our office will continue to oblige them.”

Three Men Plead Guilty to Video Taping Sexual Assault

Marcus Lewis,25, Dewayne Towner, 26, and Daniel Webster, 21, had pleaded guilty to sexual assault, and exploiting a child by video taping the encounter. The three are now off to prison after offering apologies to those they hurt.

By pleaded no contest to the charges against them, the three defendants who sexually assaulted a 16-year-old Green Bay girl and video taped the crime avoided a trial. It was that tape that landed Marcus Lewis, Dewayne Towner and Daniel Webster behind bars. Police found the video in the home where the three men were staying. At the time, officers were following up on an unrelated sexual assault complaint, of a 19-year old girl.

Dana Johnson: I obviously think they know what they did was wrong they were videotaping a 16-year-old and the were assaulting her.

Charges were reduced in court to third degree sexual assault based on what was on the tape...But the judge in case calls the video "frightening."

"I'm not losing sight of the fact that you taping it in of itself is a terrible victimization of this person," said Judge Marc Hammer.

And it's the video taping of the assault--a charge of child exploitation-- that gave the three the most time behind bars. Six years for Webster, seven years each for Lewis and Towner. Each received three years prison time on the sexual assault charge. The sentences will be served concurrently.

"We had three goals," explained assistant district attorney Dana Johnson. He says they wanted to insure they got felony convictions, prison sentences, and not to have to have the victim return to the state to testify at a trial.

The court confirmed the 16-year-old victim, as well as the 19-year-old victim for which Lewis was also sentenced for third degree sexual assault, have moved out of state and offered no victim statements. The only impact testimony came from Webster's mother.

"I'm here to support my son," Joyce Webster told the court.

Outside of court she agreed the sentence was fair.

"It's a shocker but he has to pay for his consequences," said Joyce Webster.

She says her son has expressed regret for his actions, and the other defendants offered apologies in court.

"I hurt a lot of people, made some wrong choices and I apologize for what I did," said Lewis.

Each defendant has been behind bars for nearly a year, since their arrest, that time will be subtracted from their prison sentence. Once they get out of prison each will be under extended supervision by the courts.

David Earls Receives Only 1-year Sentence for Raping 4-year-old

A woman who says she was raped by her father — the man now at the center of a controversy for the rape of a child in Pittsburg County — took her case to a national audience Friday with the hope he gets a longer prison sentence.

Through a satellite hookup in Tulsa on Friday morning, Denise Earls, 43, told CNN how she came to be raped by her father, David Harold Earls, when she was 8.

She was joined during the interview by state Rep. Mike Ritze, R-Broken Arrow, who has expressed outrage at the one-year prison sentence David Earls received last month in McAlester for the rape of a 4-year-old girl.

Ritze has also appeared on national TV in recent days, most notably the Bill O'Reilly show on Fox News, to vent his anger at the sentence and also to call for state authorities to investigate the case.

Ritze and state Rep. Mike Reynolds, R-Oklahoma City, have called for proceedings to oust Pittsburg County District Judge Thomas Bartheld, who accepted the plea bargain Earls, 64, received on May 13.

Adding intensity to the outrcy on Earls is that he will serve just three more months in a county jail and won't go to prison.

The one-year plea bargain took into account the time he was booked and held in jail since Sept. 24, 2008.

As a result, Earls is tentatively scheduled to be released Sept. 24, Pittsburg County jail administrator Missi Eldridge said.

Earls pleaded no contest last month to charges of first-degree rape and forcible sodomy.

As part of a plea bargain, he was sentenced to a year of incarceration, and 19 years of a 20-year sentence were suspended.

The plea bargain and the 4-year-old's pretrial court appearance in front of Earls triggered national and international outcries, even threats to District Attorney J.B. Miller, whose assistants agreed to the sentence.

On Friday afternoon, a bomb threat was called in to Bartheld's office, leading sheriff's deputies to evacuate the Pittsburg County Courthouse. No explosive device was found.

Prosecutors and the child's family had feared that the 4-year-old would freeze up during the planned closed-circuit testimony, Miller said. That, along with Earls' age and his terminal cancer, led to the plea bargain before the trial began.

Ritze said Denise Earls, who is not related to the 4-year-old girl, appeared on CNN on Friday with the hope that somehow her father would be punished with a longer prison sentence, "and also to make sure that what happened to her doesn't happen to someone else."

In a recent interview with The Oklahoman, Denise Earls called her father a "monster" who got a year sentence, while "I got a life sentence."

She has established a life with her husband, daughter and grandchildren and long ago separated from her father's family.

She knew nothing of her father's criminal case until her estranged mother called recently.

She said her father's sentence angers her.

"They have computers; they have all kinds of ways to determine that he has family members," she said. "You would have thought they would have tried to contact me to see if anything happened to me."

Denise Earls said the inappropriate touching began while she was living with her mother and grandmother in Blackwell. Her father was divorced from her mother when she was 1, she said, and she seldom heard from him.

In 1974 her father spent one night in the washroom behind the garage where she was living. She said that's where he raped her.

Her father told her that if she told anyone, she would no longer be allowed to live with her grandmother, she said, so she kept quiet.

"I was too afraid," she said. "My grandmother was my rock. My grandmother was my savior. She's the reason I'm a good person today."

Denise Earls said she confronted her father in 1995, after she'd been married many years.

"He said, 'I was drunk. I'm sorry. I don't remember,' " she said. "I said, 'I have vivid memories.' "

Oklahoma Attorney General Drew Edmondson has already weighed in on the allegations made by Denise Earls.

"My investigators have talked to this newly identified victim," he said.

"We're attempting to determine whether, in all likelihood, the statute of limitations has run on those offenses.

"But it would be additional information that if there were a trial of this person, Earls, that information may be admissible to show the propensity to commit this kind of crime."

Duane A Bault Arrested for Raping 11-year-old girl

A Fort Drum man living in Watertown was jailed without bail Thursday on allegations that over a two-year period he raped a girl under age 11, according to documents filed in Watertown City Court.

Duane A. Bault, 40, of 163 Breen Ave., is charged with predatory sexual assault against a child. As defined by state penal law, the charge involves committing first-degree rape, first-degree criminal sexual act and first-degree aggravated sexual abuse against a child under age 13.

The court file indicates his conduct was upon a child under age 11 and occurred in the city between Aug. 13, 2004, and July 1, 2006.

The charge is an A-II felony, which, with a conviction, carries a possible prison sentence of up to life.

Joe Harvey Jr Arrested for Sexually Assaulting Infant

A man accused of sexually assaulting his ex-girlfriend’s infant in an unincorporated area near west suburban Montgomery was ordered held on $250,000 bond this week.

Joe P. Harvey, Jr., 27, of the 0-100 block of Marnel Road in Montgomery, was charged with one count of predatory criminal sexual assault of a child, one count of aggravated criminal sexual abuse and one count of criminal sexual assault, according to a release from the Kendall County Sheriff’s office.

Harvey is accused of sexually assaulting his ex-girlfriend’s baby, whose gender and age was not immediately available, on Thursday in his home, the release said.

Thursday afternoon, the child’s mother took the baby to Rush-Copley Medical Center in Aurora after noticing injuries, the release said. Hospital staff determined the baby had been sexually abused, the release said.

The Department of Children and Family Services and the sheriff’s department was contacted and, after interviewing the child’s mother, it was determined that Harvey had allegedly abused the child.

Harvey is being held on $250,000 bond in the Kendall County jail.
